Experienced Spousal Sponsorship Lawyers

Spousal sponsorship is one of the most common pathways for Canadians wishing to reunite with their husband, wife, or common-law partner. Eligible sponsors—Canadian citizens, permanent residents, or individuals registered under the Indian Act—can apply to bring their partner to Canada as a permanent resident.

Because the application involves detailed forms, proof of relationship, financial requirements, and strict eligibility rules, even small errors can lead to delays or refusals. Submitting a complete, well-documented application the first time is crucial to avoid costly setbacks.

How We Help With Spousal Sponsorship Applications

At Mandall Immigration Law, we work extensively with clients who are sponsoring a spouse or partner, whether they are applying from inside Canada or abroad. Our firm focuses exclusively on immigration law, giving us deep knowledge of the spousal sponsorship process and the types of evidence required to demonstrate a genuine, qualifying relationship.

We help clients prepare strong applications by organizing supporting documents, addressing potential concerns in advance, and ensuring all requirements are met. Our goal is to streamline the process and present your case in the most compelling and complete way possible.

FAQs for Spousal Sponsorship in Canada

Processing times vary depending on whether the application is submitted inland or outland, and where the sponsored spouse lives. On average, most applications take 10–12 months, though timelines can change based on government workload and individual circumstances.

In many cases, yes. Your spouse may be able to apply for a visitor visa to stay in Canada during processing, but approval is not guaranteed. Inland applicants may also be eligible for an open work permit once certain stages of the application are complete.

Immigration, Refugees and Citizenship Canada (IRCC) requires substantial evidence such as:

  • Marriage certificates or proof of common-law partnership
  • Photos and communication records
  • Joint financial documents
  • Travel history together
  • Statements from family or friends

This documentation helps demonstrate that the relationship is real and not entered into for immigration purposes.

Unlike other family sponsorship streams, there is no formal minimum income requirement for spousal sponsorship. However, sponsors must show they can meet basic financial responsibilities and that they are not receiving social assistance for reasons other than disability.

If IRCC refuses the application, you may have the right to appeal the decision to the Immigration Appeal Division (IAD), depending on the circumstances. In other cases, it may be better to resubmit a stronger application addressing the reasons for refusal. An immigration lawyer can help determine the best next steps.
